Welcome to Les Belles Lavandes. The terms “we,” “us,” and “our” refer to Les Belles Lavandes S.E.N.C.

Les Belles Lavandes operates this website and online store, including the information, content, features, tools, products, and related services made available through it (collectively, the “Services”). Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer the Services.

These Terms of Service, together with the policies referred to in them (collectively, the “Terms”), describe the conditions that apply when you access or use the Services or purchase products from us.

Please read these Terms carefully. By accessing or using the Services, you agree to these Terms and to our Privacy Policy, subject to any rights that cannot be waived under applicable law. If you do not agree with these Terms, you should not use the Services.

Section 1 – Access and Account

By using the Services, you represent that you are at least the age of majority in your jurisdiction of residence or that you are using the Services with the authorization of a parent or legal guardian where permitted by law.

To browse our online store or purchase products, you may be asked to provide information such as your email address and billing, payment, pickup, or shipping information. You agree to provide information that is accurate, current, and complete and that you have the right to provide.

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account. You may not transfer or assign your account to another person without our permission.

Section 2 – Our Products

We strive to present and describe our products as accurately as reasonably possible. However, colours, textures, dimensions, or appearance may vary slightly because of screen settings, natural materials, handcrafted production, or other factors.

Many Les Belles Lavandes products are made in small batches and may have slight variations from one batch to another. These variations are part of their artisanal character and do not necessarily indicate a defect.

Products must be used only for their intended purpose and in accordance with the directions and warnings provided on the product, packaging, or product page. Cosmetic and personal-care products are not intended to diagnose, treat, cure, or prevent disease.

Product descriptions, ingredients, sizes, availability, and prices may be updated from time to time. We may discontinue a product or limit quantities, subject to applicable law.

Section 3 – Orders

Submitting an order is an offer to purchase the products in your cart. We may accept, reject, limit, or cancel an order for legitimate reasons and as permitted by law, including suspected fraud, pricing or inventory issues, or restrictions on product availability.

An order is considered accepted when we confirm acceptance or fulfillment and the required payment has been processed.

Please review your order carefully before submitting it. We will try to accommodate cancellation or modification requests, but we cannot guarantee that changes can be made after an order has entered processing.

If we reject, modify, or cancel an order, we will make reasonable efforts to notify you using the contact information provided with the order and will handle any payment already received in accordance with applicable law.

Returns and refunds are subject to our Returns & Refunds Policy and to any rights provided by applicable law.

Purchases are intended for personal or household use unless commercial resale or another use has been expressly authorized by Les Belles Lavandes.

Section 4 – Prices and Billing

Prices, discounts, and promotions may change from time to time. The price applicable to an order will be the price presented to you before the order is completed, subject to applicable consumer protection law.

Unless otherwise stated, displayed prices do not include applicable taxes, shipping fees, customs duties, brokerage fees, or other charges that may apply. Any charges we are required to disclose before completing a transaction will be presented as required by law.

Prices offered online may differ from prices offered at physical retail locations, markets, events, or independent retailers.

You agree to provide current, complete, and accurate purchase and account information. You represent that you are authorized to use the payment method submitted with your order.

Section 5 – Shipping and Local Pickup

Certain orders may be available for local pickup. Pickup location, timing, and instructions will be provided or confirmed as part of the order process or after the order is placed.

When shipping is available, delivery dates or timeframes are estimates unless otherwise expressly stated. Delays may occur because of carriers, weather, customs, or events outside our reasonable control.

We take reasonable steps to ensure that an order reaches the customer. Responsibility for delayed, lost, stolen, or missing parcels will be determined in accordance with applicable consumer protection laws and any clear delivery instructions provided by the customer.

If your order does not arrive within the expected timeframe, please contact us so that we can assist you.

Section 6 – Intellectual Property

The Services, including our trademarks, trade names, text, photographs, graphics, videos, product descriptions, designs, and other original content, are owned by or licensed to Les Belles Lavandes and are protected by applicable intellectual property laws.

You may use the Services for personal, non-commercial purposes. Unless permitted by law or authorized by us in writing, you may not reproduce, distribute, modify, republish, sell, commercially exploit, or create derivative works from our content.

The Les Belles Lavandes name, logos, product names, designs, and slogans may be trademarks or other protected intellectual property. Shopify and other third-party names and marks belong to their respective owners.

Section 7 – Optional Third-Party Tools

We may provide access to optional tools, applications, or integrations offered by third parties. We do not necessarily monitor or control those third-party tools.

Your use of optional third-party tools may be subject to the third party’s own terms and privacy practices. To the extent permitted by law, we are not responsible for third-party tools that are outside our control.

The Services may contain links to websites or services operated by third parties. We are not responsible for the content, accuracy, availability, security, privacy practices, or products of third-party websites that are outside our control.

Section 9 – Relationship with Shopify

Our online store is powered by Shopify, which provides technology and services that help us operate the store. Products sold through our store are sold by Les Belles Lavandes, not by Shopify.

To the extent permitted by applicable law, Shopify is not responsible for the products sold by Les Belles Lavandes or for obligations that belong to Les Belles Lavandes as the merchant.

Section 10 – Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy, available on our website. Shopify may also collect and process personal information in order to provide its platform and related services, in accordance with its own privacy practices.

Because the Services are hosted by Shopify, information you submit through the Services may be transmitted to Shopify and service providers in other jurisdictions. Please review our Privacy Policy for additional information.

Section 11 – Feedback, Reviews, and Submissions

If you voluntarily submit a review, suggestion, photograph, idea, comment, or other content to us (“Feedback”), you represent that you have the right to provide it and that it does not violate the rights of another person or applicable law.

Unless we agree otherwise in writing, you grant Les Belles Lavandes a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, display, and share Feedback for purposes connected with operating, improving, and promoting our business and Services, subject to applicable privacy and consumer protection laws.

We may moderate or remove Feedback that we reasonably believe is unlawful, misleading, abusive, infringing, or otherwise inappropriate.

Section 12 – Errors, Inaccuracies, and Omissions

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, transit times, or availability.

We may correct or update inaccurate information to the extent permitted by applicable law. If an error affects an order that has already been submitted, we will address the matter in accordance with applicable consumer protection law.

You may use the Services only for lawful purposes. Nothing in these Terms excludes, restricts, or replaces any legal warranty, consumer right, remedy, or liability that cannot be excluded or limited under applicable law. Goods sold to consumers in Quebec are covered by the legal warranties provided by law.

We make reasonable efforts to keep the Services accurate, secure, and available. However, except for warranties or obligations that cannot legally be excluded, we do not guarantee that the website will always be uninterrupted, error-free, or free from technical problems, or that general informational content will be suitable for every purpose.

Section 16 – Limitation of Liability

Nothing in these Terms limits or excludes liability where doing so is prohibited by law, including liability that cannot be excluded for bodily or moral injury or for intentional or gross fault.

To the fullest extent permitted by law, Les Belles Lavandes will not be liable for indirect or consequential losses arising solely from the use or unavailability of the website or from matters outside our reasonable control, except where applicable law provides otherwise.

This section does not limit any remedy you may have in relation to defective goods, non-delivery, legal warranties, or other mandatory consumer rights.

To the extent permitted by law, you are responsible for losses or third-party claims resulting from your unlawful misuse of the Services, your infringement of another person’s rights, or your material breach of these Terms.

This section is not intended to impose liability on a consumer for ordinary use of the Services or for exercising rights available under applicable law.

These Terms, together with the policies and notices expressly incorporated into them, constitute the agreement governing your use of the Services, subject to mandatory rights and obligations under applicable law.

You may not transfer your rights or obligations under these Terms in a manner that would prejudice our rights without our consent.

We may transfer or assign our rights and obligations in connection with a sale, reorganization, or transfer of our business, subject to applicable law.

These Terms are governed by the laws in force in the Province of Quebec and the applicable federal laws of Canada, subject to any mandatory consumer protection or other laws that apply to you.

Any dispute will be brought before a court or tribunal of competent jurisdiction as determined by applicable law.

Headings are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.

Section 23 – Language

These Terms are available in French and English. The French version is made available in accordance with applicable Quebec language laws. Where permitted by law, a customer may expressly choose to be bound by the English version after the French version has been provided to them.

Section 24 – Changes to the Terms

We may update these Terms from time to time to reflect changes to our Services, business practices, or legal obligations.

The most current version will be available on our website. Where required by law, we will provide notice of material changes before they take effect.

Changes will not reduce rights that cannot legally be waived or altered.
